Welcome to FamCam — a subscription service that turns your family’s everyday moments into beautifully edited highlight videos you’ll actually watch again. By accessing or using FamCam, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please discontinue use of the Service.

FamCam is owned and operated by LukeOBrien LLC, doing business as “FamCam,” a New York limited liability company (“FamCam,” “we,” “our,” or “us”). We provide a subscription-based memory-editing service that pairs families with independent video editors (“Editors”) who create monthly highlight reels from user-submitted photos and videos. 1. Use of Service
FamCam is intended for personal, non-commercial use. You agree not to use the Service for unlawful, infringing, or harmful purposes, and to submit only content that you own or have rights to share. By uploading content, you grant FamCam and your assigned Editor a limited, non-exclusive license to use, modify, and process that content solely for the purpose of creating your videos and improving the Service.

2. Data Use and AI Training
FamCam may use de-identified or anonymized data (including footage, briefing materials, and communications) to improve editing quality, train artificial-intelligence models that assist our creative and operational tools, and enhance product performance and personalization. “De-identified” means your personal identity and family details are removed prior to use. FamCam never sells your identifiable data to third parties.

3. Independent Editors
Your videos are crafted by independent Editors who work under confidentiality agreements and are vetted to meet FamCam’s standards. However, Editors are not employees of FamCam. While FamCam enforces strong policies and protective measures, we cannot guarantee an Editor’s actions beyond our reasonable control. By using the Service, you acknowledge this structure and agree that FamCam and LukeOBrien LLC are not liable for any misuse, disclosure, or unauthorized access to your content caused by an Editor or third party. You are responsible for ensuring that the footage you upload contains only material you wish to share.

4. Data Security
FamCam uses industry-standard safeguards to protect content and personal data. However, no digital platform is completely secure. In the unlikely event of a data breach, hack, or unauthorized access, FamCam and LukeOBrien LLC are not liable for resulting damages, losses, or disclosure. We will promptly notify affected users in accordance with applicable law.

5. Intellectual Property
All rights, title, and interest in the FamCam Service, including its website, design, brand assets, and software, belong to LukeOBrien LLC or its licensors. You retain ownership of your uploaded content and the delivered videos, except where you have granted FamCam limited rights as described above. You may not reproduce, resell, or commercially exploit any portion of the Service without prior written permission.

6. Refund Policy
FamCam offers a 30-day satisfaction guarantee for first-time subscribers. Refunds are subject to a written request within 30 days of purchase and specific feedback explaining why the product did not meet expectations. Refunds will not be issued for subjective reasons such as “not what I expected” or “changed my mind.” FamCam reserves the right to deny refunds in cases of abuse or fraudulent claims.

6A. Missed Submissions / Late Content Policy
Your subscription entitles you to one edited video per paid month, provided you supply the necessary footage and materials in a timely manner. You may delay your submission by up to one month in arrears without losing that month’s video. If you have not submitted eligible content within one month after the end of the billing period for which it was due, the video for that period is forfeited, and no refund or credit will be provided. This policy ensures editors can maintain scheduling consistency and uphold production quality.

7. Service Interruption
We may temporarily suspend or modify the Service for maintenance, updates, or technical reasons. FamCam is not liable for delays, failures, or interruptions due to causes beyond our control, including power outages, natural disasters, or internet disruptions.

8. Limitation of Liability
To the fullest extent permitted by law, LukeOBrien LLC, its members, officers, directors, affiliates, partners, suppliers, and employees are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, goodwill, data, or content, arising from or related to your use or inability to use the Service. FamCam’s total liability shall not exceed the amount you paid for the Service in the preceding 12 months.

9. Indemnification
You agree to defend and hold harmless LukeOBrien LLC and its officers, employees, partners, and contractors from any claims, losses, damages, liabilities, or expenses (including reasonable legal fees) arising from your use of the Service, your uploaded content, or your violation of these Terms or applicable law.

10. Changes to These Terms
FamCam may update or modify these Terms at any time. Changes take effect when posted on our website. Continued use of the Service constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes will be resolved exclusively in the courts of New York County, New York.
